به اساس فيصله محکمه ابتدائيه علی آباد ولايت کندز بالای سه تن که متهم بر لواطت بودند؛ به تاريخ ۱۰/ ۶/ ۱۴۴۶ هـ ق در محضر عام حکم جزای تعزیری تطبيق شد.
محکمه ابتدائيه از جمله متهمين يک متهم را به هفت سال حبس تنفيذی و ۳۹ دُره جزای تعزیری، متهم دوم را به پنج سال حبس تنفيذی و ۳۹ دُره جزای تعزیری و متهم سوم را به چهار سال حبس تنفيذی و ۳۹ دُره جزای تعزیری محکوم کرده بود.
