General Directorate Human Resource

The Supreme Court Human Resource Department has been one of the most tendered and assisting judicial institutions that follows up on the assigned duties regarding solving staff issues and other personnel related duties of the judicial and administrative employees.

The Human Resource Department which has had responsibility of Supreme Court’s foreign relations and organizing Judicial Stage courses at a time is now assigned to resolve staffing and personnel issues of one of the three government branches (the judiciary). Formation of the Supreme Court was remarkably expanded following the new Law on Structure and Mandate of Courts and so the responsibilities of human resources grew as well.

Based on the ToR, the Human Resource Department is bound to process recruitment of newly hired personnel in accordance with the law, and strengthen its relations with the Ministry of Labor and Social Affairs regarding hiring graduates of Law and Sharia faculties as well as religious Madrasas, and take necessary actions for placement of the cadre based on their qualifications and experience.

  • Human Resource Department is responsible to analyze and evaluate staff situation and placement of judges and their effectiveness in the Court’s organization and other offices of the Supreme Court and present specific suggestions to the Supreme Court respectively.
  • Proposals of appointment of newly hired judges and also presenting cadre degree to judges and other personnel related proposals are prepared by this department. Then, after ratification by the Supreme Court High Council, they will be dispatched to the President’s Office for approval.
  • The Human Resource Department accurately arranges and organizes recruitment files related to the judges and other administrative personnel, takes timely actions regarding promotions, retirements, service extension, and removal by retirement of the personnel through the appointed commission.
  • When necessary, the authorized commission creates appointments based on instructions of the Chief Justice to hire administrative and judicial personnel.
  • The commission assists in strengthening personnel balance and stability, and cooperates with Research and Studies General Department of Supreme Court in introducing judges to different short-term professional capacity building training, judicial training, and Judicial Stage.
  • Fulfils instructions and decrees of the President, and the Chief Justice issued directly or based on result of a contingency audit regarding rewards and punishments of personnel (including dismissal).

The Supreme Court Human Resource Department implements all the enforced laws and decrees, including Labor Law and Law on Organization and Jurisdiction of Courts as criteria for action to regulate its duties based on these laws and is directly responsible for Judicial General Department and the Supreme Court.

Report of Personnel Department Performance in 2008

Structure of the Supreme Court consisted of 6289 people in the past year, where 2150 posts were judicial and the rest of the positions included the Military Court and Administrative sections. There are 4545 positions in Judicial and Administrative sections; and the Human Resource Department conducted the following activities for better regulation and solidarity of personnel performance.

Judicial section:

  • Judicial appointments of 253 persons where 205 persons were Stagers of 24thperiod have been received from Presidential Office and are already appointed.
  • Ratification of High Council and approval of the Presidential Office have been received for appointment and transformation of 154 judges, meanwhile appointment and conversion of 801 judges have been considered in the authority framework of Supreme Court.
  • Necessary measures taken on appointment negation of 21 judges based on the agreement of related offices and dismissal cancellation of 7 judges and their reappointment.  In 2008, about 3 judges were banished from their duties, 23 judges resigned due to duty absenteeism, and also 83 female judges, whose duties were in the provinces, were reassigned to Kabul Courts.

Administrative section:

  • Recruitment and appointment Stages of 186 Stagers of 25th period of Stage, and 63 persons of other applicants have been completed where 179 of them were of bachelor degrees, 43 others of 14th grade and 27 persons holding a secondary education diploma.
  • Administrative officers’ records have been organized alphabetically and each safe identified by file number.

Challenges of Administrative Cadre of the Year 2008

  • 26 persons resigned due to absenteeism
  • 13 persons transferred their agreement letters to other administrations
  • 24 persons transferred their agreement letters from other administrations to the Supreme Court
  • Four persons died during the past year
  • 6 employees detained on charge of bribery
  • 5 employees fired over duty neglect
  • 2 employees placed in suspension


Curriculum Vitae of 1455 center and provincial judges on file in 2008, submitted report for Central Statistics Organization on time, and 8 officers of Human Resource Department, with cooperation of Administrative Reforms Commission, completed the Duty Bills Arrangement Special Training and received their certificates.

Records section:

  • Records section implemented promotion of 353 judges and 316 administrative employees, the service of 92 judges and 38 administrative employees was extended, 43 judges and 49 administrative employees were directed to retirement.
  • Written forms and properties registration forms prepared for 389 administrative employees and Stagers of 25th period and also for 63 newly hired employees, and 74 Service Announcement Cards of the retired employees including judges and employees were sent to retirement treasury.
  •  82 cleaners were promoted after completion of their service period.

Attendance of officers was regularly controlled by the Records section, report of officers’ attendance sent to Administrative and Financial Department for processing their salaries, and 18973 collateral documents of retired employees sent to Retirement Department, and 24093 Marriage Certificates, after confirmation, sent to Consulate of Foreign Ministry.
